The agreement

Welcome to Brewly! These Terms of Service ("Terms") govern your use of our coffee tracking platform and services. By creating an account or using Brewly, you agree to these Terms.

If you don't agree with these Terms, please don't use our service. We've tried to make these terms as clear and fair as possible, but if anything is unclear, reach out to us at legal@brewly.app.

Who can use Brewly: You must be at least 13 years old to use Brewly. If you're between 13–18, you need parental consent. Users in the EU have additional protections under GDPR.

Your account

Account creation

Accounts are created by signing in with Google. You agree to:

  • Accurate information — keep your profile truthful and current
  • Secure sign-in — keep your Google account secure; Brewly has no separate password
  • One account — don't create multiple accounts to abuse the service

Account responsibility

You're responsible for:

  • All activity that happens under your account
  • Notifying us immediately of any unauthorized access
  • All content you post or share through your account

Account termination

You can delete your account anytime from Settings. We may suspend or terminate your account if you violate these Terms or engage in harmful behavior.

Your content & intellectual property

Your content ownership

You retain all rights to the content you create:

  • Coffee beans — bean descriptions, ratings, notes
  • Brewing recipes — your recipes, techniques, and brewing logs
  • Photos — images you upload

License to Brewly

By posting content, you grant Brewly a license to:

  • Display your public content (beans you add and your favorite recipes) to other users
  • Store and process your content to provide the service
  • Create backups of your content for data protection

This license is:

  • Non-exclusive — you can use your content elsewhere
  • Revocable — delete your account and the license ends
  • Limited — only for operating and improving Brewly

Community content

Brewly is a collaborative catalog. Beans you add are visible to the community. Of your brew log, only recipes you mark as favorite are shared with others — the rest stays visible to you alone. Other users can view but never edit your recipes.

Brewly's intellectual property

Brewly owns:

  • The Brewly name, logo, and branding
  • The platform, code, and design
  • Any features and functionality we develop

You can't copy, modify, or redistribute our platform without permission.

Acceptable use policy

Brewly is a community platform for coffee enthusiasts. To keep it positive and safe, you agree not to:

Prohibited content

  • Illegal content — anything that violates laws in your jurisdiction or the EU
  • Harmful content — hate speech, harassment, threats, or violence
  • Inappropriate content — adult content, graphic violence, or disturbing material
  • Spam — unsolicited advertising or repetitive content
  • Misinformation — deliberately false information that could harm others
  • Copyright infringement — content you don't have rights to use

Prohibited actions

  • Abuse the service — hacking, scraping, or overwhelming our systems
  • Impersonate others — pretending to be another person or entity
  • Circumvent restrictions — trying to bypass account limits or security measures
  • Sell access — reselling, renting, or transferring your account
  • Collect user data — harvesting other users' information

Enforcement

If you violate these policies, we may:

  • Remove the offending content
  • Warn you about the violation
  • Temporarily suspend your account
  • Permanently terminate your account
  • Report illegal activity to authorities

Disclaimers & liability

Service "as is"

Brewly is provided "as is" without warranties of any kind. While we strive for reliability:

  • We don't guarantee uninterrupted or error-free service
  • We may modify or discontinue features
  • Content accuracy is not guaranteed
  • You use the service at your own risk

Limitation of liability

To the extent permitted by EU law:

  • Data loss — we're not liable for lost data (but we do regular backups!)
  • Indirect damages — we're not responsible for indirect, incidental, or consequential damages
  • Third-party content — we're not liable for content posted by other users
  • Maximum liability — our total liability is limited to €100 or the amount you've paid us (currently €0 as the service is free)

Important: Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited under EU law.

Indemnification

You agree to indemnify (protect) Brewly from claims arising from:

  • Your violation of these Terms
  • Your violation of others' rights (like copyright)
  • Your misuse of the service

Governing law & disputes

Governing law

These Terms are governed by the laws of the EU country where Brewly is established, without regard to conflict of law provisions. As a service operating in the EU, we also comply with:

  • General Data Protection Regulation (GDPR)
  • EU Consumer Rights Directive
  • EU Digital Services Act (DSA)
  • Applicable national consumer protection laws

Dispute resolution

If you have a dispute with Brewly:

  • Step 1: Contact us — email legal@brewly.app. We'll try to resolve it informally.
  • Step 2: Mediation — if informal resolution fails, we can try mediation.
  • Step 3: Legal action — as a last resort, disputes will be resolved in the competent courts.

EU consumer rights

If you're an EU consumer, you have additional rights:

  • Right to withdraw — you can delete your account within 14 days with no reason
  • Local jurisdiction — you can bring legal action in your country of residence
  • ODR platform — access the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr

Changes to these terms
